Terms of service

These are the terms under which Cib Label Pty Ltd ("we", "us", "our"), an Australian company (ACN 697 586 075), operates this store and website (the "Services"). By accessing, using, signing up to, or purchasing from the Services, you agree to be bound by these Terms of Service, and you acknowledge our Privacy Policy. If you do not agree, do not use the Services.

Eligibility

The Services are for adults only. You must be at least 18 years old to use the Services. By using the Services, you confirm you are 18 or older and that any information you provide is true, current, and complete.

Our Products

We take care to represent our products accurately. Colours, fabric texture, and product appearance may differ between what you see on a screen and the physical product, depending on your device and screen settings. We do not warrant that products will match their on-screen appearance.

Product descriptions and details may change at any time without notice. We may discontinue any product and may limit quantities.

Gift Cards and Store Credit

Gift cards and store credit can only be issued by Cib Label and only redeemed at Cib Label (www.ciblabel.com) towards the purchase of products, and cannot be used with any other retailer or for any other purpose. Gift cards are valid for 3 years from the date of issue. Gift cards and store credit can be used across multiple orders until the balance is used. Where an order total is more than the remaining balance, the difference must be paid using another accepted payment method. Gift cards cannot be redeemed or exchanged for cash and are non-refundable. If a gift card expires before the balance is used, any remaining balance is forfeited and cannot be redeemed for cash or store credit. Gift cards are delivered digitally by email. Keep your gift cards safe. We are not responsible for their loss or theft, or for their use without your authorisation. We may refuse or cancel a gift card where we believe it has been obtained fraudulently or without authorisation. Gift cards are non-refundable regardless of the payment method used to purchase them, including Afterpay.

Store credit may be issued by us at our discretion, for example following an eligible return, and is held against your Cib Label customer account and applied automatically at checkout. You must have a Cib Label customer account to be able to use store credit. Store credit can be redeemed only at Cib Label (www.ciblabel.com) and cannot be redeemed or exchanged for cash. Store credit expires three years after being issued.

Orders

When you place an order, you are making an offer to purchase. We may accept or decline any order at our discretion. Your order is not accepted until we confirm it. Payment must be received and processed before an order is accepted.

Your purchases are subject to our Returns and Refund Policy. By ordering, you confirm that the purchase is for your own personal or household use, not for commercial resale or export.

Pre Orders

We may offer items for pre-order, meaning you reserve an item before it goes on general sale. Full payment is required at the time of order, however the product may be shipped at a later time.

You may cancel a pre-order by emailing hello@ciblabel.com with your order number any time before your order is dispatched. Cancellations before dispatch are refunded in full to the original payment method. Once an order has been dispatched it is treated as any other order and our Returns and Refund Policy applies.

Pre-orders are dispatched from launch day. Dispatch times depend on order volume at launch and are estimates only. Nothing in this section limits your rights under the Australian Consumer Law.

Prices and Payment

Prices, discounts, and promotions are subject to change without notice. The price charged is the price in effect at the time the order is placed, as set out in your order confirmation email.

Prices are displayed and charged in your local currency where available; our base currency is Australian dollars (AUD). For orders delivered within Australia, prices include GST. For international orders, applicable customs duties and import taxes may be charged by the destination country on or after delivery and are the responsibility of the recipient, as set out in our Shipping Policy.

We accept Shopify Payments (Visa, Mastercard, American Express, Google Pay, Apple Pay, Samsung Pay, Shop Pay), PayPal, and Afterpay. Payment processing is handled by each respective provider. We do not store your full payment card details.

Shipping

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, or events outside our control. Title to the products passes to you once we have received full payment. Risk of loss or damage in transit passes to you once your order has been dispatched to the carrier. If a parcel goes missing or arrives damaged, contact us and we will help you resolve it with the carrier. Nothing in these Terms limits your rights under the Australian Consumer Law.

Discount Codes and Promotions

Discount codes are subject to any stated conditions, may be single-use, cannot be applied after an order is placed, and may be withdrawn at any time. We may cancel orders where a code has been used in breach of its conditions.

Intellectual Property

The Services, including all trademarks, brand names, text, designs, images, graphics, videos, and audio, and the design and arrangement of those elements, are owned by Cib Label Pty Ltd or its licensors and are protected by Australian and international intellectual property laws.

You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, republish, download, store, or transmit any of our material without our prior written consent.

Cib™ is a trade mark of Cib Label Pty Ltd, accepted by IP Australia and awaiting registration across multiple classes. Unauthorised use of this mark is prohibited.

Third-Party Tools and Links

The Services may include third-party tools or hyperlinks to other websites. We do not monitor or control those tools and websites and provide access on an "as is, as available" basis without any warranty. We have no liability for your use of optional third-party tools or third-party websites.

Relationship with Shopify

Cib Label is powered by Shopify. Your sales and purchases are made directly with Cib Label Pty Ltd. Shopify is not responsible for any aspect of any sale or transaction between you and Cib Label Pty Ltd.

Privacy

Your personal information is handled in accordance with our Privacy Policy. By using the Services, you acknowledge that we handle your personal information as set out in that policy. Where we need your consent, such as for marketing or for optional cookies and tracking pixels, we ask for it separately.

Feedback

If you submit ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us permission to use that Feedback for any purpose without obligation to compensate you. You confirm that you have all necessary rights to the Feedback you submit.

Errors and Inaccuracies

We may correct any errors, inaccuracies, or omissions in the Services at any time, and may change or update information or cancel orders if any information is inaccurate, without prior notice.

Acceptable Use

You may use the Services only for lawful purposes. You must not use the Services for any unlawful or harmful purpose, to violate any laws or regulations, to infringe intellectual property rights, to harass any person, to transmit false or misleading information, to transmit spam, to impersonate anyone, or to interfere with anyone else's use of the Services.

Termination

We may suspend or terminate your access to the Services at any time, without notice, for any reason. You remain liable for any amounts due up to and including the date of termination. Any provisions of these Terms that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and indemnification, survive termination.

Disclaimer

Except as expressly stated by Cib Label Pty Ltd, and subject to your rights under the Australian Consumer Law (which cannot be excluded), the Services are provided on an "as is" and "as available" basis. We do not guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free. We may modify, suspend or discontinue the website, or any part of it, at any time without notice.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with goods, you are entitled to a replacement or refund. You may also be entitled to compensation for reasonably foreseeable loss or damage.

Limitation of Liability

To the fullest extent permitted by law, we exclude all liability for any indirect, incidental, special, or consequential loss or damage, loss of profits, loss of revenue, loss of data, loss of goodwill, or loss of anticipated savings, however caused, whether in contract, tort (including negligence), statute, or otherwise, arising from or related to the Services or any product purchased through the Services.

To the fullest extent permitted by law, our total liability to you for any claim arising from or related to the Services or any product purchased through the Services will not exceed the total amount paid by you for the specific product or order giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other right or remedy under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, or paying the cost of replacing the goods.

To the fullest extent permitted by law, these exclusions and limitations of liability apply for the benefit of Cib Label Pty Ltd and each of its directors, officers, employees, contractors and agents, and no claim arising from or in connection with the Services or any product purchased through the Services may be brought personally against any director, officer, employee, contractor or agent of Cib Label Pty Ltd. Nothing in this paragraph excludes, restricts or modifies any right or remedy under the Australian Consumer Law that cannot be excluded, restricted or modified by agreement.

Indemnification

You agree to indemnify and hold harmless Cib Label Pty Ltd, Shopify, and our affiliates, officers, directors, employees, agents, contractors, and service providers from any losses, damages, liabilities, or claims arising from your breach of these Terms, your violation of any law, your infringement of any third-party right, or your use of the Services. This indemnification does not apply to claims arising from our failure to comply with the Australian Consumer Law or any liability that cannot be excluded by law.

Product Use and Care

You are responsible for using products in accordance with their intended purpose and any care or use instructions, including those on garment labels. We are not liable for damage, injury, or loss arising from misuse of a product or failure to follow care instructions.

Disputes

If you have a dispute with us, contact us first at hello@ciblabel.com with your order number and a description of the issue.

We will make reasonable attempts to resolve the matter with you directly. If a matter cannot be resolved through direct communication, it may be escalated through appropriate means.

Force Majeure

We are not liable for any failure or delay in performing our obligations where it results from circumstances beyond our reasonable control, including natural disasters, pandemics, postal or courier disruptions, industrial action, government actions, or supply chain interruptions.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the unenforceable part will be severed without affecting the remaining provisions.

Waiver and Entire Agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, along with our other policies, constitute the entire agreement between you and us.

Governing Law

These Terms are governed by the laws of the State of New South Wales, Australia. You and Cib Label Pty Ltd consent to the exclusive jurisdiction of the courts of New South Wales.

Changes to These Terms

We may update these Terms at any time by posting updates to our website. Your continued use of the Services after a change constitutes acceptance of the updated Terms.

Mobile Terms of Service

The Cib Label mobile message service (the "Service") is operated by Cib Label Pty Ltd ("Cib Label", "we", or "us"). Your use of the Service constitutes your agreement to these Mobile Terms. We may modify or cancel the Service at any time, and to the extent permitted by law may modify these terms; your continued use after a change is acceptance of it.

By consenting to Cib Label's SMS service, you agree to receive recurring marketing text messages from or on behalf of Cib Label at the mobile number you provide. Messages may be sent using automated technology and may include promotional content as well as service messages such as order and account updates.

You do not have to sign up to make a purchase, and consent is not a condition of any purchase. Participation is voluntary. We do not charge for the Service, but message and data rates may apply depending on your mobile plan; you are responsible for those charges. Message frequency varies.

You can opt out at any time by tapping the unsubscribe link included in every text message we send. You will receive a one-time opt-out confirmation, after which no further marketing messages will be sent unless you re-subscribe.

You agree to provide a valid mobile number and to tell us if it changes. Mobile carriers are not liable for delayed or undelivered messages. To the extent permitted by law, we are not liable for failed, delayed or misdirected messages, errors in content, or any action taken in reliance on the Service. We respect your privacy.
